Intra Company Transferee (ICT)

An intra company transferee is an employee who is transferred from one subsidiary or affiliate of a company to another subsidiary or affiliate within the same multinational organization. In Canada, the process for obtaining an intra company transferee visa is similar to that in other countries, but with some specific requirements and considerations.

To qualify for an intra company transferee visa in Canada, the employee must first obtain an International Mobility Program (IMP) work permit. This permit allows the employee to work in Canada for up to two years, depending on the nature of the transfer. To obtain an IMP work permit, the employee must provide evidence that they are transferring to a position in Canada that is managerial, executive, or requires specialized knowledge, and that they have been employed with the company for at least one year within the past three years.

In addition to the IMP work permit requirements, the employee must also meet the general requirements for a work permit in Canada, such as having a valid passport and being able to demonstrate ties to their home country. The employee must also be able to show that they have the financial means to support themselves during their stay in Canada.

Once the employee has been approved for an IMP work permit, they will be able to work in Canada for up to two years, depending on the nature of the transfer. After two years, the employee may be eligible to apply for a permanent residence visa, which allows them to live and work in Canada permanently.

Intra company transferees can provide a valuable source of knowledge and expertise for a company, and can help to facilitate the exchange of ideas and best practices among different subsidiaries and affiliates. However, it is important for the employee to carefully consider the implications of an intra company transfer, including the potential impact on their career development, as well as the cultural differences that may exist between their home country and Canada. It is also important for the employer to ensure that all necessary requirements and procedures are followed in order to obtain the necessary work permit and LMIA for the employee.
